The platform, including but not limited to practice questions, examinations, passages, explanations, analytics, designs, software, databases, text, graphics, logos, trademarks, and other content, is owned by or licensed to Infynno UCAT and is protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not:

• Copy, reproduce, distribute, publish, or transmit content from the platform.
• Create derivative works based on platform content.
• Resell, sublicense, or commercially exploit any part of the platform.
• Remove copyright, trademark, or proprietary notices.

Access to the platform does not transfer ownership of any intellectual property rights to users.

You agree not to use the platform in any manner that violates applicable laws, regulations, or these Terms.

Without limitation, you must not:

• Use the platform to facilitate academic dishonesty, cheating services, or unauthorized examination activities.
• Copy, harvest, scrape, extract, or systematically collect content, questions, answers, or data from the platform.
• Use automated tools, bots, scripts, crawlers, or similar technologies to access or interact with the platform without prior written authorization.
• Attempt to reverse engineer, decompile, disassemble, or otherwise analyze the platform's underlying software or systems.
• Introduce malicious code, malware, viruses, or harmful technologies.
• Conduct denial-of-service attacks, penetration attempts, security testing, or other activities intended to disrupt or compromise the platform.
• Circumvent security measures, access controls, usage limits, or technical restrictions implemented by the platform.

We reserve the right to investigate suspected violations and take appropriate action.

Infynno UCAT Portal is provided as an educational and examination preparation tool.

While we strive to provide accurate and useful content, we do not guarantee:

• Any particular UCAT score.
• Admission to any university, college, or educational institution.
• Improvement in examination performance.
• The completeness, accuracy, or suitability of all educational materials for every user.

Your examination outcomes depend on numerous factors beyond our control, including individual preparation, performance, examination conditions, and external circumstances.

The platform should be used as a supplementary learning resource and not as a guarantee of academic or professional outcomes.

We may suspend, restrict, or terminate access to the platform, with or without prior notice, where reasonably necessary to protect the platform, users, or our legitimate interests.

Examples include:

• Violations of these Terms.
• Fraudulent, deceptive, or unlawful activities.
• Security incidents or unauthorized access attempts.
• Abuse of platform resources.
• Use of prohibited automated tools or scraping activities.
• Conduct that may harm other users or the platform.

Upon termination, access to some or all platform features may be removed immediately.

Any provisions of these Terms that by their nature should survive termination shall continue to remain in effect.

To the maximum extent permitted by applicable law, Infynno UCAT, its owners, employees, affiliates, contractors, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of, or inability to use, the platform.

This includes, without limitation:

• Loss of educational opportunities.
• Examination results or outcomes.
• Loss of data.
• Loss of profits, revenue, goodwill, or business opportunities.
• Service interruptions or technical failures.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Some features of Infynno UCAT Portal, including mock examinations and premium content, may require approved access.

Access is requested through the platform and granted at our discretion after review. By using restricted features, you agree to:

• Not share, transfer, or misuse access granted to your account.

We may change available plans or features from time to time. Where reasonably practicable, we will notify you of material changes that affect your access.

Your use of the platform is also governed by our Privacy Policy, which explains how personal information is collected, used, stored, shared, and protected.

By using Infynno UCAT Portal, you acknowledge that you have read and understood our Privacy Policy. Where these Terms and the Privacy Policy address the same subject matter, both documents apply together.

You may submit content through the platform, such as feedback, support messages, survey responses, or other communications ("User Content").

You retain ownership of your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, store, display, and process that content solely to operate, maintain, improve, and support the platform.

You are solely responsible for your User Content and represent that:

• You have the right to submit the content and to grant the license described above.
• Your User Content does not violate applicable law or infringe the rights of any third party.
• Your User Content is accurate to the best of your knowledge where factual statements are made.

We may review, remove, restrict, or refuse to display User Content that we reasonably believe violates these Terms, applicable law, or the rights of others, or that is otherwise inappropriate, harmful, or misleading.

We aim to keep Infynno UCAT Portal available and reliable, but we do not guarantee that the platform will be available at all times or free from interruptions, delays, errors, or security vulnerabilities.

Access may be affected by:

• Scheduled maintenance, upgrades, or platform improvements.
• Emergency maintenance or security-related downtime.
• Technical failures, network issues, or outages affecting our systems or third-party providers.
• Events beyond our reasonable control, including internet disruptions, power failures, or force majeure events.

Where reasonably practicable, we will try to provide advance notice of planned maintenance that may affect access to examinations or other time-sensitive features.

We are not liable for loss or inconvenience arising from temporary unavailability of the platform, except where liability cannot be excluded under applicable law.

We work to provide high-quality educational materials, but practice questions, mock examinations, explanations, passages, and related content may occasionally contain errors or become outdated.

Without limiting the Educational Disclaimer above:

• Questions, answers, and explanations may be updated, corrected, or removed at any time.
• Educational content may contain inadvertent mistakes, omissions, or ambiguities.
• You should independently verify important information, especially where it may affect examination preparation or academic decisions.

If you believe content on the platform is inaccurate or misleading, please notify us so we can review and, where appropriate, correct it.

The platform may integrate with or rely upon third-party services for hosting, content delivery, analytics, authentication, payment processing, and other operational functions.

Examples may include cloud infrastructure providers, analytics tools, and performance monitoring services.

We are not responsible for the availability, content, policies, security practices, or conduct of third-party providers. Your use of third-party services may be subject to separate terms and privacy policies imposed by those providers.

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Infynno UCAT, its affiliates, officers, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the platform.
• Your User Content.
• Your violation of these Terms or applicable law.
• Your infringement or alleged infringement of any third-party rights.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

We may update these Terms from time to time to reflect changes to the platform, our services, legal requirements, or business practices.

When we make material changes, we will take reasonable steps to notify you, such as by posting the updated Terms on the platform and updating the "Last Updated" date.

Your continued use of the platform after revised Terms become effective constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the platform.

These Terms are governed by applicable law, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or your use of Infynno UCAT Portal shall be subject to the exclusive jurisdiction of the courts with competent jurisdiction, except where mandatory consumer protection laws require otherwise.

Nothing in this section limits any rights you may have under applicable law that cannot be waived by agreement.
